Please read this End User License Agreement ("EULA") carefully before downloading, installing, accessing, or using Pianello. By accessing or using the app, you agree to be bound by this EULA. If you do not agree to these terms, do not use Pianello.
This EULA is a legal agreement between you and Leon Fellner e.U. (trading as "Pianello") ("we", "us", or "our") only. Apple Inc. ("Apple") is not a party to this EULA and is not responsible for Pianello or its content, except as expressly set out in Section 15 (Third-Party Beneficiary – Apple) below.
Pianello (the "Licensed Application" or "App") is licensed, not sold, to you. Your use of the App is also subject to the Apple Media Services Terms and Conditions, including the applicable Usage Rules (the "Usage Rules"). In the event of any conflict between this EULA and the Usage Rules, the Usage Rules will govern to the extent of the conflict.
Subject to your ongoing compliance with this EULA and the Usage Rules, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to download, install, and use Pianello for your personal, non-commercial use on any Apple-branded products that you own or control, and as permitted by the Usage Rules.
If the Usage Rules allow Family Sharing or similar shared access programs, then your license extends to those family members or users in accordance with the Usage Rules, provided that each user agrees to and complies with this EULA.
Except as expressly permitted in this EULA or by applicable law, you agree that you will not, and will not permit others to:
Pianello is licensed to you, not sold. The App and all associated intellectual property rights (including but not limited to copyrights, trademarks, trade names, logos, and trade secrets) are and will remain the exclusive property of Leon Fellner e.U. and its licensors. All rights not expressly granted to you in this EULA are reserved.
Certain features of Pianello may require you to create an account. You agree to provide accurate, current, and complete information and to keep that information up to date. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You must notify us promptly of any unauthorized use of your account.
You must be at least 13 years old to use Pianello. If you are under the age of majority where you live, you may only use the App under the supervision of a parent or legal guardian who agrees to be bound by this EULA on your behalf.
You agree to use Pianello only for lawful purposes and in compliance with this EULA, the Usage Rules, and all applicable laws, rules, and regulations.
Pianello may offer both free and premium features. Access to certain features requires a paid subscription (a "Subscription"). Details about the available plans, durations, and pricing are provided in the App and in the App Store listing, and may change from time to time.
Subscriptions are billed in advance on a recurring basis (for example, monthly or annually) through your Apple ID account. Your Subscription will automatically renew at the end of each billing period unless you cancel it at least 24 hours before the end of the current period. The renewal charge will be applied to your Apple ID account within 24 hours prior to the end of the current period at the then-current Subscription price.
You can manage and cancel your Subscription at any time in your Apple ID account settings on your device. Deleting the App does not automatically cancel your Subscription. We do not have access to or control over the billing relationship between you and Apple; it is your responsibility to manage your Subscription through Apple.
Refunds for payments made through the App Store are handled exclusively by Apple in accordance with its policies. We do not issue direct refunds for purchases made via your Apple ID. You may contact Apple directly to request a refund if permitted by Apple’s policies or applicable law.
Your use of Pianello is also governed by our Privacy Policy, which is incorporated into this EULA by reference. Please review it carefully to understand how we collect, use, and safeguard your information.
You agree that we may collect and use technical data and related information — including but not limited to technical information about your device, system and application software, and peripherals — that is gathered periodically to facilitate the provision of software updates, product support, analytics, and other services related to Pianello. We may use this information, in a form that does not personally identify you, to improve our products and services, all as described in our Privacy Policy.
Pianello may allow access to or rely on certain third-party services, content, or materials ("Third-Party Services"), such as cloud storage, analytics, or external websites. Your use of Third-Party Services may be subject to separate terms and privacy policies established by those third parties. We are not responsible for, and do not endorse, any Third-Party Services, and we make no representations or warranties about them.
Apple is not responsible for any Third-Party Services used in connection with Pianello.
We are solely responsible for providing any maintenance and support services with respect to Pianello, as required under applicable law or as described in this EULA and any applicable App Store policies. You acknowledge that Apple has no obligation whatsoever to furnish any maintenance or support services with respect to the App.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PIANELLO IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND. YOUR USE OF THE APP IS AT YOUR SOLE RISK.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE AND OUR LICENSORS EXPRESSLY DISCLAIM ALL WARRANTIES AND CONDITIONS, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO ANY IMPLIED WARRANTIES OR CONDITIONS OF MERCHANTABILITY, SATISFACTORY QUALITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, QUIET ENJOYMENT, AND NON-INFRINGEMENT, AND ANY WARRANTIES ARISING OUT OF COURSE OF DEALING OR USAGE OF TRADE.
WE DO NOT WARRANT THAT PIANELLO WILL BE ERROR-FREE OR UNINTERRUPTED, THAT DEFECTS WILL BE CORRECTED, OR THAT THE APP OR THE SERVERS THAT MAKE IT AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. NO ORAL OR WRITTEN INFORMATION OR ADVICE GIVEN BY US, OUR AUTHORIZED REPRESENTATIVES, OR APPLE SHALL CREATE A WARRANTY.
Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you. In such cases, the exclusions will apply only to the extent permitted by applicable law.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL WE OR OUR AFFILIATES, LICENSORS, OR SERVICE PROVIDERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES WHATSOEVER, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, LOSS OF DATA, BUSINESS INTERRUPTION, OR ANY OTHER COMMERCIAL DAMAGES OR LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE PIANELLO, HOWEVER CAUSED, REGARDLESS OF THE THEORY OF LIABILITY (CONTRACT, TORT, OR OTHERWISE), EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATED TO THIS EULA OR YOUR USE OF PIANELLO SHALL NOT EXCEED (A) THE AMOUNTS YOU HAVE ACTUALLY PAID FOR ACCESS TO PIANELLO DURING THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) IF YOU HAVE NOT PAID ANY AMOUNTS, FIFTY (50) EURO.
Nothing in this EULA is intended to exclude or limit any liability that cannot be excluded or limited under applicable law (for example, in some jurisdictions, liability for death or personal injury caused by negligence, or for intentional misconduct).
Between Apple and us, we are solely responsible for addressing any claims by you or any third party relating to Pianello or your possession and/or use of the App, including but not limited to:
This EULA does not limit your rights under applicable consumer protection laws.
In the event of any third-party claim that Pianello or your possession and use of the App infringes that third party’s intellectual property rights, we, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim, to the extent required by this EULA and applicable law.
You represent and warrant that you are not located in a country that is subject to a U.S. Government embargo or that has been designated by the U.S. Government as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties. You agree that you will not use or otherwise export or re-export Pianello except as authorized by United States law and the laws of the jurisdiction(s) in which the App was obtained.
You acknowledge and agree that Apple, and Apple’s subsidiaries, are third-party beneficiaries of this EULA, and that, upon your acceptance of the terms and conditions of this EULA, Apple will have the right (and will be deemed to have accepted the right) to enforce this EULA against you as a third-party beneficiary thereof.
This EULA is effective until terminated by you or us. Your rights under this EULA will terminate automatically without notice from us if you fail to comply with any term(s) of this EULA. Upon termination, you must cease all use of Pianello and delete all copies of the App from your devices.
We may also suspend or terminate your access to Pianello (in whole or in part) if we reasonably believe that you have violated this EULA, the Usage Rules, or any applicable law, or for any other legitimate business reason, subject to any mandatory notice or other requirements under applicable law.
This EULA and your use of Pianello are governed by and construed in accordance with the laws of Austria, excluding its conflict of law rules. If you are a consumer and reside in a country within the European Union or the United Kingdom, you may benefit from mandatory provisions of the law of your country of residence, and nothing in this EULA shall limit your rights under those mandatory provisions.
You and we agree that the courts of Graz, Austria, shall have non-exclusive jurisdiction over any dispute or claim arising out of or in connection with this EULA or your use of Pianello, without prejudice to any mandatory jurisdiction rules that apply to you as a consumer.
We may modify this EULA from time to time, for example to reflect changes in our services, legal obligations, or business practices. When we make material changes, we will take reasonable steps to notify you, such as by updating the date at the top of this EULA, providing a notice within the App, or by other appropriate means. Your continued use of Pianello after the effective date of any changes constitutes your acceptance of the revised EULA. If you do not agree to the changes, you must stop using the App and, if applicable, cancel your Subscription.
If any provision of this EULA is held to be invalid, illegal, or unenforceable, that provision shall be enforced to the maximum extent permissible, and the remaining provisions shall continue in full force and effect.
Our failure to enforce any right or provision of this EULA shall not constitute a waiver of such right or provision. Any waiver must be in writing and signed by us to be effective.
You may not assign, transfer, or delegate this EULA or any of your rights or obligations hereunder without our prior written consent, and any attempted assignment without such consent will be null and void. We may assign or transfer this EULA, in whole or in part, without restriction and without notice to you, to the extent permitted by applicable law.
This EULA, together with our Privacy Policy and any additional terms referenced herein or made available to you in connection with Pianello (such as specific subscription or promotional terms), constitutes the entire agreement between you and us regarding Pianello and supersedes all prior or contemporaneous understandings between you and us relating to its subject matter.
